Who Can File a Wrongful Death Claim?
Our service area covers both Ohio and Kentucky, and these states have specific laws about who has the legal right to file a wrongful death claim. In Ohio, only the personal representative of the deceased person's estate can file a wrongful death lawsuit. This is typically the executor named in the will or an administrator appointed by the probate court if no will exists. The personal representative files on behalf of the surviving family members who are legally entitled to recover damages, primarily the surviving spouse, children, and parents of the deceased.
Kentucky law is similar but with some distinctions. The personal representative of the estate must file the wrongful death action, and they do so for the benefit of specific family members in a particular order of priority. The surviving spouse and children are the primary beneficiaries. If there's no spouse or children, the parents of the deceased may recover. If none of these relatives exist, other next of kin may be entitled to compensation. Kentucky also has a shorter statute of limitations for wrongful death claims, typically one year from the date of death, compared to Ohio's two-year limit.
Both states allow recovery for damages, including medical expenses incurred before death, funeral and burial costs, lost income and benefits the deceased would have provided, loss of companionship and guidance, and the pain and suffering the deceased experienced before passing.
