Ohio & Kentucky Dog Bite Law: Who Is Liable and Why It Matters

Ohio Revised Code Section 955.28 holds dog owners, keepers, and harborers strictly liable for injuries their animals cause. You don’t need to prove the owner knew the dog was dangerous or did anything wrong. The bite itself establishes liability. There are exceptions: if you were committing criminal trespass or another criminal offense (other than a minor misdemeanor) on the owner’s property, or teasing, tormenting, or abusing the dog at the time of the attack, the strict liability rule may not apply.

Ohio common law also provides a separate path for victims who can show the owner knew the dog had dangerous tendencies. Prior bites, aggressive behavior, or a failure to restrain a dog with known issues can all support a negligence claim under this theory, and this path can open the door to punitive damages that the strict liability statute alone doesn’t allow. Landlords and property owners may share liability when they knew about a dangerous dog on their premises and did nothing about it. On the Kentucky side of our service area, KRS Section 258.235(4) similarly imposes strict liability on dog owners for all damages their dog causes, regardless of the animal’s history.
