Ohio & Kentucky Pedestrian Accident Cases, Handled by a Team That Picks Up the Phone
Pedestrians have no structural protection in a collision. A vehicle traveling at 25 miles per hour can cause traumatic brain injuries, spinal cord damage, broken bones, and internal injuries severe enough to require months of treatment and surgery. Even lower-speed impacts can permanently change a person’s life. According to the Ohio State Highway Patrol, Hamilton County recorded 379 pedestrian accidents in 2023, with 16 of them fatal.
What pedestrians do have is legal protection. Ohio and Kentucky both place a clear duty on drivers to watch for and avoid striking people on foot, and when drivers fail that duty, injured pedestrians can pursue compensation for what they’ve lost. Our personal injury team at Merk Injury Law handles pedestrian accident cases across both states, including for residents in Northern Kentucky and Covington. We’ve helped over 3,800 clients throughout Ohio and Kentucky, and we handle every case on a contingency fee basis. You pay nothing unless we recover compensation for you.
Pedestrian accidents can lead to catastrophic injuries, including traumatic brain injuries, that demand aggressive legal representation. When those accidents are fatal, surviving family members may have grounds for a wrongful death claim. We’re here for both.
Merk Injury Law has earned glowing testimonials from injured pedestrians we’ve represented. Call us at (513) 466-0034 or contact us online to request your free consultation.

Pedestrian Right-of-Way Laws in Ohio & Kentucky
Our service area spans communities across Ohio and Kentucky, and both states have clear laws designed to protect people on foot. Understanding those rules is central to establishing driver liability in your case.
Ohio Pedestrian Right-of-Way Rules
In Ohio, pedestrians have the right-of-way in marked crosswalks and at intersections, even where no painted crosswalk exists. Drivers must yield to pedestrians who are crossing or about to cross the roadway, and Ohio law separately requires drivers to exercise due care to avoid striking pedestrians under any circumstances. That duty doesn’t disappear simply because a pedestrian is outside a crosswalk.
Kentucky Pedestrian Right-of-Way Rules
Kentucky’s pedestrian laws are similarly protective. Pedestrians have the right-of-way at marked crosswalks and at intersections without traffic control signals. When a pedestrian is crossing lawfully, drivers must stop and remain stopped until the pedestrian has completely cleared their lane. Pedestrians carry responsibilities too: obeying traffic signals, using crosswalks where provided, and yielding to vehicles when crossing outside designated areas.
How We Build Your Case
When drivers violate these right-of-way laws and strike a pedestrian, they can be held liable for the resulting injuries. Our team uses traffic laws, accident reconstruction, witness testimony, and other evidence to build a strong case for compensation.
What Compensation Can Cover After a Pedestrian Accident
The financial impact of a pedestrian accident can be staggering. Medical bills accumulate quickly, income stops, and the road to recovery can stretch for months or years. A successful claim can pursue compensation across several categories.
Economic damages include past and future medical expenses, lost wages, and reduced earning capacity if your injuries prevent you from returning to the same work. In cases involving permanent disability or serious disfigurement, long-term care costs can represent a significant portion of the claim’s value.
Non-economic damages cover what the bills don’t capture: pain and suffering, emotional distress, and loss of enjoyment of life. These are real losses, and they may be compensable.
When a pedestrian accident is fatal, surviving family members may be able to pursue a wrongful death claim covering funeral expenses, loss of financial support, and loss of companionship. Insurance companies routinely attempt to minimize or deny claims across all of these categories. Our team documents and quantifies every category of damage to support your claim fully.
