Ohio & Kentucky Motorcycle Laws
The applicable helmet, protective eyewear, equipment, and comparative fault rules depend on whether the crash and claim arise under Ohio or Kentucky law.
Ohio Helmet & Eye-Protection Requirements
Ohio requires protective eye devices for motorcycle operators and passengers. Helmet requirements apply to riders under 18, riders with a novice designation, and riders operating under a temporary instruction permit. Ohio also regulates required motorcycle lighting and equipment, and its laws recognize a motorcycle operator’s right to full use of a traffic lane.
Lane position and alleged traffic violations can become points of dispute in an accident case. Rather than assuming that a particular riding maneuver establishes fault, we examine the current law, the circumstances of the crash, and whether the rider’s conduct contributed to the collision or claimed injuries.
Kentucky Helmet & Eye-Protection Requirements
Kentucky requires approved eye protection for motorcycle operation. Protective headgear is required for riders under 21, motorcycle instruction-permit holders, and certain operators who have held a motorcycle license for less than one year. Kentucky also regulates motorcycle equipment and lane use, so allegations about lighting, positioning, or another traffic violation must be evaluated under Kentucky law.
Comparative Fault in Motorcycle Claims
Both states use comparative fault rules, but they don’t apply them in the same way. In Ohio, damages can be reduced by the injured person’s assigned percentage of fault, and recovery generally isn’t available when that person’s fault exceeds 50%. Kentucky, by contrast, applies a pure comparative fault rule, allocating fault among responsible parties and reducing damages in proportion to the injured person’s assigned share, without a cutoff point that bars recovery entirely.

The legal effect of that conduct depends on the facts, the applicable state’s law, and its connection to the crash or injuries.
