Common Workplace Accidents and Employer Liability
Workplace accidents happen across all industries, from construction sites to office buildings. Understanding how these accidents occur and when employers may be held liable helps clarify your path to compensation.
Our legal team has experience with work accident cases involving:
- Falls from heights. Construction workers, maintenance staff, and others who work on ladders, scaffolding, or roofs face serious injury risks when proper safety equipment or fall protection isn't provided.
- Slip, trip, and fall accidents. Wet floors, uneven surfaces, poor lighting, cluttered walkways, and inadequate maintenance create hazards that can result in broken bones, head injuries, and back problems.
- Equipment and machinery accidents. Defective machinery, lack of proper training, missing safety guards, or failure to follow lockout/tagout procedures can lead to crushing injuries, amputations, or death.
- Vehicle and forklift accidents. Warehouse workers, delivery drivers, and others who operate or work around vehicles face collision risks, especially when employers fail to maintain equipment or provide adequate training.
- Falling objects. Workers in warehouses, construction sites, and retail environments can be struck by improperly stored materials, tools, or merchandise that falls from shelves or overhead areas.
- Chemical exposure. Failure to provide proper protective equipment, ventilation, or training when working with hazardous substances can cause burns, respiratory problems, and long-term health issues.
- Repetitive stress injuries. Employers who don't provide ergonomic workspaces or allow adequate breaks may contribute to carpal tunnel syndrome, back injuries, and other conditions that develop over time.
While workers' compensation typically covers most workplace injuries regardless of fault, employers can face additional liability when they intentionally create dangerous conditions or act with gross negligence. Third parties like equipment manufacturers, subcontractors, or property owners may also be liable and can be sued separately from a workers' comp claim.
